Terms and Conditions - Amendment

COVID-19 is active, worldwide, with associated health risks and restrictions that could, without warning, affect and cause significant disruptions, cancellation and changes to any and all travel arrangements by way of COVID-19 outbreaks, sudden border closures, quarantine or lockdown orders, airport closures, government travel advisories, return home directives, hospitalization for treatment and other similar consequences; and consequences not reasonably foreseeable at this time.

 

COVID 19 Restrictions and Policies when travelling

Until further notice, there will be specific restrictions in place while travelling due to Covid 19.  These restrictions may vary from provider to provider and country to country.  In most situations, you will be required to wear a non-medical face mask that covers your nose, mouth and chin.  This includes in airports, during flights and other transportation methods, and while in enclosed, public places with specific exceptions in place.

You may also be required to provide a verbal or written questionnaire regarding possible COVID-19 symptoms and exposure, a non-contact temperature check, and proof of COVID-19 vaccination.

Entry into other countries may also be subject to specific restrictions, such as Covid-19 testing, proof of vaccination, quarantines of up to 14 days upon arrival as well as possible entry bans for some countries, regardless of your citizenship. Fully vaccinated Canadians returning to Canada may avoid the 14 day quarantine provided certain conditions are met, please review the latest information here; https://travel.gc.ca/travel-covid

While away, we recommend you monitor local media to stay informed of the COVID-19 situation where you are.  It is also recommended that you register with the Registration of Canadians Abroad service with your up to date contact information should consular officials need to contact you in case of emergency. https://travel.gc.ca/travelling/registration

Please note that additional restrictions can be imposed suddenly and policies can change without notice.  Flights can be suspended or reduced, your travel plans can be disrupted and it may be difficult for your to return home.  It is your responsibility to stay informed of the situation.

Elgin Travel & COVID-19

Due to the impacts associated with the spread of COVID-19, the general conditions of your booking may change and be different from what was originally discussed at the time of booking.  You are encouraged to consult with your travel professional or refer to individual supplier websites for the most up to date information and conditions.

Should your trip be cancelled by the supplier due to COVID-19, the value of your trip may be protected by a Future Travel Credit rather than a refund. Some suppliers may also allow you to cancel your travel arrangements, depending on your departure date, and provide you with a Future Travel Credit. The validity of your credit will be valid for at least 1 year from the date of cancellation, possibly longer. Finally, some suppliers may also offer protection plans that may allow you to cancel, change, or transfer your trip - these typically must be purchased at the time of booking and your agent will advise you of the availability of these protection plans before confirming your travel arrangements.  These plans typically cannot be added after deposit is paid.  There may also be additional Elgin Travel service fees associated with rebooking or cancellation of travel arrangements due to COVID-19.

Travel Insurance and COVID-19

Travel insurance for trip cancellation and interruption and emergency out-of-province medical insurance is highly recommended. Please note that standard travel insurance will not cover any claims caused by COVID-19 as it is a known event. There is additional insurance coverage available for purchase that will cover emergency medical expenses related to Covid 19 or cancellations for ANY reason with specific terms and conditions. As well, travel insurance does not cover cancellation claims where a future travel credit has been issued as this is not considered a financial loss. Please inquire with your travel professional if you are unsure of available coverage.

WAIVER OF RIGHTS AND RELEASE OF LIABILITY

By signing below and/or reserving travel services with Elgin Travel and Cruises and/or A-DestinationWedding.com, you expressly acknowledge that you and everyone who is a part of the booking understand and are in agreement with the invoice, including the terms and conditions as stated on your invoice as well as the information above.  As well, you voluntarily assume all the COVID-19 risks and other risks involved with such travel, whether those risks are expected or unexpected.

In the event that some or all of your travel arrangements are cancelled, interrupted or otherwise affected by COVID-19, your rights and remedies shall be as determined and limited by the cancellation, rebooking, refund and/or other policies as set out  by the supplier of the affected travel service, as set out in its brochures and/or websites.

Elgin Travel, its employees, directors and agents will in no circumstances be liable to you for any refund, loss, damage, delay or injury resulting from any cancellation, interruption or other event or failure of any supplier to provide any travel service to you or for any other breach of contract or the intentional or careless act or omission of any supplier of any such travel service.

I/We hereby waive all and any rights or claims that I/we may have against Elgin Travel and Cruises arising directly or indirectly from the occurrence of any COVID-19 risks, or the failure, whether negligent or otherwise, of the Travel Agency to inform of any COVID-19 risks or precautions to take or required documents to travel.

This waiver and release of liability is in addition to the terms and conditions of Elgin Travel and Cruises, A-DestinationWedding group terms, and the terms and conditions of the suppliers providing the travel services that are a part of the booking.

Credit Card Authorization

Elgin Travel and Cruises is a TICO licensed travel agency, authorized to conduct business with all travel suppliers including but not limited to airlines, tour operators, travel insurance companies, cruise lines, hotels and car rental agencies.  Elgin Travel will never charge your credit card without your prior authorization, whether by phone or by email.

If you are paying for any or all of your travel arrangements by credit card, please complete the boxes below before signing and submitting your authorization and acceptance of terms.

I authorize Elgin Travel and Cruises, to charge the agreed upon travel arrangements including any professional fees (FTS/Elgin Travel) to the credit card provided to my travel professional. I agree that I will pay for this purchase in accordance with the issuing bank cardholder agreement.

By signing below and/or by reserving travel services with Elgin Travel and Cruises, you expressly acknowledge that you and your travel companions have understood and are in agreement with this invoice, including the Terms and Conditions as stated on this invoice as well as the supplier/tour operator general conditions, and that you have been sufficiently advised on such matters or have sought any additional desired guidance. 

You acknowledge that you and your travel companions have been offered comprehensive Travel Insurance coverage and that you have made an informed decision to take out or refuse such insurance and to assume full responsibility for your decision.
